Acceptable Use Policy
This Acceptable Use Policy governs the use of the MyQCart POS software, website, and related services by clients and their end users.
This Acceptable Use Policy ("AUP") applies to all users of the MyQCart website, software, applications and related services (collectively, the "Services"). It forms part of the agreement between you and ORVIK GROUP LTD, trading as MyQCart, and should be read together with our Terms of Service, Privacy Policy and other applicable policies.
By using the Services, you agree not to engage in any of the activities described below.
1. Prohibited Activities
You must not use the Services to:
- Gain unauthorized access ("hack") to any system, network, account, or data belonging to MyQCart, other Clients, or any third party.
- Abuse or overload the Services, including through excessive automated requests, denial-of-service attempts, or actions intended to disrupt availability for other users.
- Upload, transmit, or introduce malware, viruses, trojans, worms, ransomware, or any other malicious code into the Services or connected systems.
- Reverse engineer, decompile, or disassemble the Services or attempt to derive the source code, algorithms, or underlying structure of the software, except to the extent expressly permitted by applicable law.
- Circumvent security or licensing controls, including usage limits, authentication mechanisms, or copy protection.
- Scrape, harvest, or extract data from the Services beyond what is provided through supported features and APIs.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the Services for unlawful purposes, including fraud, money laundering, tax evasion, or the sale of prohibited or illegal goods.
- Upload unlawful, defamatory, obscene, or infringing content, or content that violates the intellectual property or privacy rights of any third party.
- Resell or sublicense access to the Services without MyQCart's prior written consent.
- Attempt to bypass or disable security features, monitoring systems or audit logs.
- Use the Services in a manner that infringes applicable data protection or privacy laws.
- Use the Services to send unsolicited bulk communications (spam) or phishing messages.
- Interfere with or disrupt the integrity or performance of the Services or their connected systems.
- Test, scan, or probe the vulnerability of the Services or infrastructure without prior written authorisation from MyQCart.
- Remove or alter copyright notices, trademarks, or proprietary notices on any part of the Services.
- Use automated bots or scripts to interact with the Services except through officially supported APIs.
- Use the Services to develop, benchmark, or create a competing product or service, or engage a third party to do so on your behalf.
2. Client Responsibility for End Users
Clients are responsible for ensuring that their End Users (staff, cashiers, or other authorized individuals) comply with this AUP. A breach of this policy by an End User is treated as a breach by the Client.
Clients remain responsible for all activity performed through their accounts, whether carried out by employees, contractors, or other authorised users.
Clients are responsible for maintaining the security of their own devices, passwords and local networks. MyQCart cannot be held responsible for security incidents resulting from compromised user credentials, malware on customer devices, or failure to follow recommended security practices.
3. Reporting Violations
If you become aware of any actual or suspected violation of this AUP or any security vulnerability affecting the Services, please notify us promptly at support@myqcart.com.
4. Consequences of Violation
Violations of this AUP may result in:
- A warning and request to remedy the violation.
- Temporary suspension of access to the Services.
- Termination of the Client's account, in accordance with the Terms of Service.
- Referral to law enforcement, where the violation may constitute a criminal offence.
MyQCart reserves the right to investigate suspected violations and take appropriate action, including preserving relevant data for legal or security purposes. We may take immediate action where necessary to protect the security, integrity, or availability of the Services.
5. Changes to This Policy
We may update this AUP from time to time. Material changes will be notified through our website or by email where appropriate. Continued use of the Services following publication of the updated policy constitutes acceptance of the revised policy.
